These Terms apply to all sales unless otherwise agreed in writing by Digital Square. Nothing in these Terms is intended to exclude, restrict or limit any rights or remedies that cannot lawfully be excluded under applicable South African law.
1. GENERAL TERMS
1.1 All orders are subject to product availability, pricing and confirmation by Digital Square.
1.2 Product specifications, availability and pricing may change without prior notice and are subject to confirmation at the time of order.
1.3 Digital Square reserves the right to correct any pricing, specification or product-description errors that may occur.
1.4 An order will only be considered confirmed once payment has been received and the order has been accepted by Digital Square, unless otherwise agreed in writing.
1.5 Digital Square currently operates on a Cash on Delivery (COD) / payment-before-release basis, unless alternative payment terms have been approved in writing.
1.6 Products remain the property of Digital Square until payment has been received in full.
2. PRODUCT INFORMATION AND SPECIFICATIONS
2.1 Customers are responsible for reviewing product specifications and ensuring that a product meets their requirements before purchasing.
2.2 Product images are for illustrative purposes and may differ slightly from the actual product supplied.
2.3 Product specifications, colours, accessories and packaging may change from those displayed online due to manufacturer or supplier changes.
2.4 Digital Square will make reasonable efforts to ensure that product descriptions and specifications are accurate.
2.5 Customers are encouraged to contact our sales team if they require clarification regarding a product before placing an order.
3. DEVICE AGE AND PERFORMANCE DISCLAIMER
3.1 Customers purchasing pre-owned, refurbished, discontinued or older-generation products are responsible for understanding the age, specifications and capabilities of the product before purchase.
3.2 Older devices may naturally have limitations, including but not limited to:
- Reduced processing performance
- Reduced battery capacity or battery life
- Compatibility limitations
- Limited availability of replacement parts
- Limited or discontinued manufacturer support
- Devices that no longer receive the latest software or operating-system updates
3.3 These characteristics do not automatically constitute a product defect.
3.4 By purchasing an older, pre-owned or refurbished device, the Customer acknowledges that they have considered the age and specifications of the product and accepts the normal performance limitations associated with that product.
4. WARRANTY TERMS AND CONDITIONS
4.1 The warranty applicable to each product will be stated on the quotation, invoice, product listing or other applicable sales documentation.
4.2 If the warranty period or warranty conditions for a product are unclear, Customers should contact Digital Square before purchasing.
4.3 Unless otherwise specified, the warranty period is calculated from the original date of purchase/invoice.
4.4 Products from major or multinational brands may be covered by the manufacturer's warranty and may need to be handled directly through the manufacturer's Authorised Service Provider (ASP).
4.5 Digital Square may direct a Customer to the applicable ASP where the manufacturer's warranty applies.
4.6 The warranty covers defects that fall within the applicable manufacturer's or Digital Square's warranty conditions.
4.7 Warranty claims do not cover damage caused by misuse, negligence, accidental damage, unauthorised modifications, unauthorised repairs or other exclusions listed in these Terms.

- Printer cartridges or similar consumable products
7. WARRANTY CLAIM PROCEDURE
7.1 All products returned for warranty purposes must first be inspected, tested and verified by Digital Square or the applicable Authorised Service Provider.
7.2 A warranty claim does not automatically entitle the Customer to an immediate replacement or refund.
7.3 The product will be assessed to determine whether the reported fault falls within the applicable warranty.
7.4 Customers must provide reasonable proof of purchase, such as the original invoice or other acceptable proof of purchase.
7.5 Where required, the Customer must provide the applicable Customer Repair Order (CRO) or service documentation when collecting the repaired or replaced product.
7.6 Digital Square will endeavour to process warranty claims as quickly as reasonably possible. Any repair or assessment time provided by a technician, workshop or supplier is an estimate and may change depending on the nature of the fault, availability of parts and the applicable service provider.
7.7 Customers are responsible for backing up all data before submitting a device for repair, testing or replacement.
7.8 Digital Square is not responsible for loss of data, software, files or information stored on a product submitted for warranty assessment or repair.
7.9 Customers should remove passwords, personal accounts and other security restrictions where reasonably possible to allow the device to be tested.
8. WARRANTY REPLACEMENTS
8.1 Where a product is confirmed to be defective and qualifies for replacement, Digital Square may provide:
- A replacement product of the same model, where available
- A product of equivalent specification, where appropriate
- Another remedy permitted under applicable law and the relevant warranty conditions
8.2 If the original product is discontinued or has reached end-of-life, Digital Square may offer an equivalent replacement or another applicable remedy.
8.3 If a suitable replacement is unavailable, Digital Square may provide store credit or another applicable remedy, subject to the applicable warranty, agreement and consumer protection requirements.
8.4 Any replacement product supplied under warranty will carry the applicable remaining warranty period from the original purchase date, unless a longer warranty is required or otherwise agreed.
9. WARRANTY EXCLUSIONS
A warranty claim may be rejected where inspection establishes that the fault or damage resulted from circumstances outside the applicable warranty.
This may include:
9.1 Physical damage caused by misuse, negligence, poor handling or accidental damage.
9.2 Burn marks, overheating or damage caused by incorrect use.
9.3 Unauthorised modifications, repairs or attempted repairs by third parties.
9.4 Missing, altered or illegible serial numbers or original product identification labels.
9.5 Tampered, removed or broken security seals where such seals are relevant to the warranty.
9.6 CPU damage caused by incorrect cooling, incorrect fan installation, overheating or overclocking.
9.7 Mainboard or component damage caused by:
- Incorrect BIOS upgrades
- Incorrect BIOS settings

- Unauthorised modifications
- Physically damaged or bent pins
9.8 Damage caused by:
- Power surges

9.9 Products that have been deliberately marked, written on, altered or tampered with.
9.10 Any other damage or condition specifically excluded by the manufacturer's warranty.
Where a warranty claim is rejected, Digital Square may provide the Customer with the reason for rejection and, where applicable, advise on available repair options at the Customer's cost.
10. WARRANTY COLLECTION AND DELIVERY
10.1 Customers are responsible for delivering warranty products to the Digital Square service centre or applicable Authorised Service Provider unless otherwise agreed in writing.
10.2 Customers are responsible for collecting repaired or replacement products unless otherwise agreed.
10.3 Any courier, collection or delivery service arranged at the Customer's request may be charged to the Customer.
10.4 Where applicable law requires Digital Square to bear a cost associated with a valid warranty or consumer remedy, this clause will not limit that legal requirement.
11. DEAD ON ARRIVAL (DOA) – 7-DAY ASSESSMENT AND REPLACEMENT POLICY
11.1 Certain products, including but not limited to notebooks, printers, LCD/LED monitors and televisions, may be subject to the manufacturer's or Authorised Service Provider's DOA policy.
11.2 A product reported as potentially DOA within 7 days of purchase must be returned for assessment.
11.3 The original invoice or other acceptable proof of purchase must be provided to verify the purchase date.
11.4 DOA products must be returned with all reasonably required accessories and components, including power cables, chargers, manuals and other supplied accessories where applicable.
11.5 The product must first be inspected and tested by Digital Square or the applicable Authorised Service Provider.
11.6 A product will only be treated as DOA where the applicable service provider or Digital Square confirms that the product has a qualifying manufacturing defect and meets the applicable DOA requirements.
11.7 Where a qualifying DOA product is confirmed and a replacement is available, Digital Square may provide a replacement in accordance with the applicable warranty and consumer protection requirements.
11.8 Where a replacement is not available, Digital Square may offer an equivalent product, store credit or another applicable remedy, subject to the applicable law and warranty conditions.
11.9 A DOA claim does not automatically mean that a product will be exchanged without assessment.
11.10 Any replacement supplied under a DOA claim will carry the applicable warranty period from the original purchase date, unless otherwise required by law or agreed in writing.
12. AUTHORISED SERVICE PROVIDERS
Where manufacturer warranty or service is applicable, the following service providers may be used, subject to the manufacturer's current arrangements:

12.2 Digital Square reserves the right to refer products to the manufacturer's current authorised service provider where applicable.
13. RETURNS AND CHANGE-OF-MIND PURCHASES
13.1 Digital Square does not generally accept returns or provide refunds solely because a Customer has changed their mind, ordered the incorrect product, purchased the incorrect specification or no longer requires the product, subject to any rights that cannot lawfully be excluded.
13.2 This policy does not affect a Customer's rights relating to products that are defective, incorrectly supplied, damaged upon delivery or otherwise subject to a remedy under applicable law.
13.3 Any voluntary return accepted by Digital Square outside of a warranty or legal remedy will be subject to Digital Square's approval and may be subject to a handling or restocking fee.
14. STORE CREDIT
14.1 Where Digital Square agrees to provide store credit for an approved return that is not a warranty or statutory remedy, the store credit may be subject to a 10% handling/restocking fee, where permitted by applicable law.
14.2 Store credit will be calculated as: Purchase amount – applicable handling/restocking fee = Store credit
14.3 Store credit:
- Is valid for 6 months from the date of issue
- May be used towards a future Digital Square purchase
- Is non-transferable
- Is not redeemable for cash, except where required by applicable law
14.4 Store credit issued for a valid warranty, DOA or other legally required remedy will be handled in accordance with the applicable legal requirements and will not automatically be subject to the voluntary return handling fee.
15. SALE AND DISCOUNTED PRODUCTS
15.1 Sale and discounted products are subject to the same applicable warranty and statutory consumer rights as other products unless a specific lawful exception applies.
15.2 A discounted price does not, by itself, remove a Customer's rights relating to a valid product defect or warranty claim.
15.3 Change-of-mind returns on sale or discounted products will not generally be accepted.
15.4 Any voluntary return of a sale or discounted product will require prior approval from Digital Square and may be subject to applicable handling or restocking fees.

16.5 Nothing in this section limits any rights the Customer may have under applicable consumer protection legislation.
17. COURIER, DELIVERY AND COLLECTION FEES
17.1 Unless otherwise agreed, delivery, return shipping and collection costs are the responsibility of the Customer.
17.2 Orders below the applicable Digital Square delivery threshold may be subject to a delivery fee.
17.3 Where a Customer requests collection, return or redelivery, applicable courier charges may be payable by the Customer.
17.4 Where applicable law requires Digital Square to cover delivery, return or collection costs in connection with a valid consumer remedy, Digital Square will comply with that requirement.
18. DATA AND PERSONAL INFORMATION
18.1 Customers are responsible for backing up their data before sending any device to Digital Square or an Authorised Service Provider.
18.2 Digital Square will take reasonable care of products submitted for assessment or repair but cannot guarantee against data loss arising during diagnostics, repair, replacement or resetting of a device.

19.3 Digital Square will not be responsible for indirect losses, loss of business, loss of profit or loss of data to the extent that such exclusion is permitted by law.
20. PRICING AND AVAILABILITY
20.1 All prices are subject to confirmation at the time of order.
20.2 Prices may change due to supplier pricing, exchange-rate fluctuations, manufacturer changes, stock availability or other commercial factors.
20.3 Digital Square reserves the right to correct obvious pricing or listing errors before an order is fulfilled.
20.4 Where a product becomes unavailable after an order has been placed but before fulfilment, Digital Square will contact the Customer regarding available alternatives or an applicable remedy.
21. PRODUCT COMPATIBILITY
21.1 Customers are responsible for confirming that products are compatible with their existing hardware, software, network, operating system and other equipment.
